We regularly take instructions to prepare Interim Schedules of Dilapidations during the lease term. Our Landlord clients are provided with a fully costed version of the Schedule, the version served on the Tenant being uncosted in accordance with industry protocols. This enables our clients to remain informed as to the financial value of the Tenant's accrued liabilities despite the fact no claim for damages is being pursued at that stage.
Our most common appointment is the preparation of Terminal Schedules of Dilapidations prior to, or at, expiry of the lease term. This provides an accurate summary of all covenant breaches, together with the necessary remedial works and associated remedial costs which, in turn, forms part of the subsequent claim in damages. In parallel with this, we put together the Quantified Demand with supporting evidence to enable the Landlord to present a robust claim in damages for later proceedings if settlement negotiations fail.
